Effective Evaluative Mediation: Skills, Strategies and Techniques

This workshop is designed for NECR students and alumni who want to work in the growing field of mediation, participate in mediation as an advocate, and/or apply these dispute resolution skills to a current career field. This includes attorneys, arbitrators, human resource professionals, ombudspersons, directors, managers, planners, union representatives, and anyone who wants to learn conflict resolution skills for professional, personal, and community benefit. This event is not open to the public; it is only open to  SPS students and alumni. 

Through a simulated role play of a real case, students will have the opportunity to translate theory into practice. Shifting dialectic to dialogue through evaluative mediation is demonstrated through a joint session and a two to three rounds of confidential caucus leaving sufficient time for debrief and Q&A.

Participants will be split into three groups: (1) Mediation team to shadow the mediator; (2) Plaintiffs' team; (3) Defendants' team

Students who role play plaintiff or defendant have the opportunity to practice their negotiation skills and its application in mediation, learn how to determine what to reveal, when and how to frame it, and how an evaluative dialogue provides a reasoned basis for reevaluating settlement.
